This checklist is designed to help you align your Influencer Marketing campaign with FTC guidelines and legal regulations.

Disclosure Guidelines

  1. Make sure your disclosure is placed on an obvious spot (where consumers can see it).
  2. Ensure the disclosure is easily understandable. Stay away from abbriviations. Use terms as “sponsored”/”ad”.
  3. Is the disclosure in the same language as the main message?
  4. If the content piece is a story, include disclosure over every part of it.
  5. If the content piece is audio/video, include the disclosure in the description, as well as in the audio/video produced.

Copyright compliance

  1. Prepare a written agreement or a contract between parties involved (brand, influencers).
  2. Assign any rights of ownership of the content.
  3. Specify what parties involved can/cannot do with the content.

Fair advertising rules

  1. Verify your statement before you make it.
  2. The statement must reflect the truth.
  3. Do not include false statements or claims you cannot prove.
